South Luffenham Parish Council, Rutland

South Luffenham Cemetery

South Luffenham Parish Council is responsible for the management and maintenance of South Luffenham Cemetery.

The Council maintains the cemetery records, allocates grave spaces, manages Exclusive Rights of Burial, and gives permission for burials, interments of cremated remains and memorials.

If you are arranging a burial, interment or memorial and are unsure which form you need, please contact the Parish Clerk.

Burials and interments

All burials and interments of cremated remains must be arranged with the Parish Council in advance.

A Cemetery Interment Application should be completed and returned to the Clerk before the proposed interment. The Clerk will confirm the grave or plot details, applicable fees and any supporting documentation required.

Where an existing grave is to be reopened, the Council may also need to confirm who holds the Exclusive Right of Burial and that the person giving consent has authority to do so.

Exclusive Rights of Burial and reserving a grave

Purchasing an Exclusive Right of Burial (ERoB) gives the registered owner burial rights in a particular grave space for a defined period.

For South Luffenham Cemetery, Exclusive Rights of Burial are currently granted for 50 years.

Purchasing an Exclusive Right of Burial does not mean that you own the land itself. The cemetery land remains under the control of South Luffenham Parish Council.

Applications to purchase an Exclusive Right of Burial should be made using the Council’s application form. Grave spaces are allocated by the Council, although individual wishes will be accommodated where reasonably possible.

Memorials and headstones

Permission must be obtained from South Luffenham Parish Council before a new memorial is installed or alterations are made to an existing memorial.

This includes:

  • headstones
  • flat stones
  • vases
  • additional inscriptions
  • alterations or work to an existing memorial

A Cemetery Memorial Application should be submitted and approved before any work takes place.

The application will normally be completed in conjunction with the memorial mason carrying out the work.

Cemetery fees

The Council sets fees for:

  • burials and interments
  • interment of cremated remains
  • Exclusive Rights of Burial
  • memorials
  • additional inscriptions

Different rates apply depending on whether the deceased was resident in South Luffenham, elsewhere in Rutland or outside Rutland.

The current fee schedule also includes provisions for certain people who were living outside Rutland because they had moved into a nursing home or were being cared for by relatives.

Please refer to the current Cemetery Fees document for full details.

Grave ownership

Grave ownership can sometimes become complicated, particularly where the registered owner of an Exclusive Right of Burial has died.

The Exclusive Right of Burial may need to be formally transferred before another burial can take place or permission can be given for memorial work.

Our Guide to Grave Ownership explains:

  • what an Exclusive Right of Burial means
  • the rights of the registered owner
  • the 50-year period of the right
  • what happens when the registered owner dies
  • transferring burial rights
  • responsibility for memorials
  • applying for future burials and memorial work

If you are dealing with an older family grave and are unsure who currently holds the burial rights, please contact the Clerk before making arrangements.

Cemetery Rules and Regulations

Everyone using the cemetery, including funeral directors, grave diggers and memorial masons, must comply with the Council’s Cemetery Rules and Regulations.

These cover matters including interments, allocation of grave spaces, Exclusive Rights of Burial, memorials, grave maintenance, planting and items placed on graves.
